Chapter 7 Bankruptcy - Debt Liquidation

Although a chapter 7 bankruptcy will discharge some debt, there are limitations. Debt such as student loans, child support payments, and most past due taxes cannot be discharged in a bankruptcy. Many non exempt property or assets may require liquidation in order to pay some debts, such as a valuable unsecured vehicle, firearms, or substantial equity in a home or other real estate.

Is Chapter 7 Right for me?

Although in many cases, filing for chapter 13 bankruptcy is in the individual's best interest, chapter 7 is the simpler and less expensive route. Individuals and business entities who qualify are able to file for chapter 7 bankruptcy. However, it is frequently an unavailable option. It is not an option for individuals who have filed for a previous bankruptcy within the last 8 years and obtained a discharge.
