  • Chapter 7 bankruptcy: Chapter 7 is structure for individuals or entities with little or no assets to lose in liquidation and bankruptcy. Chapter 7 is a simpler and cheaper form of bankruptcy, but not necessarily the best in your case. All qualified debt is discharged.

    Eligibility for ch. 7 is based on your income, debts, expenses, and whether your debts are mostly business or consumer. You may have a liquidation if you have certain types of assets ("non-exempt) adding up to at least $1000-1500. The question of whether or or not an asset is exempt is not always obvious. If you have a ch. 7 with a liquidation, you will be required to turn over these assets or pay the value in cash to keep them.

  • Chapter 11 bankruptcy: Chapter 11 is structured for corporations or other business entities with extensive debt and assets who plan to continue the business after declaring bankruptcy.

  • Chapter 12 bankruptcy: Chapter 12 is structured for family farmers who plan to continue operating the farm, yet do not qualify for chapter 13.

  • Chapter 13 bankruptcy: Chapter 13 is structured for individuals, businesses, and farmers that qualify. It reorganizes a percentage of the debt into a repayment plan and discharges the remainder upon completion of the plan. The percentage paid ranges from 0% to 100% depending on various factors.

    Ch. 13 is generally for people with one or more of the following situations: (1) do not qualify for chapter 7 because of high income or previous bankruptcy in the last 6-8 years; (2) need help catching up on house or car payments; (3) need help with past due taxes or child support; or (4) want to avoid liquidation of assets in chapter 7. In chapter 13 there is never a liquidation of assets.
